Terms Of Service (TOS)

SHORTENED TOS
NOTICE: This is the SHORTENED version of the TOS.Detailed info may be missing. The sole purpose of this shortened version is for the Customer to have an easy overview of the main points. Please refer to the full TOS down below for more detailed terms, which WILL apply to your orders.

TERMS OF SERVICE
LAST UPDATED: [9. APRIL, 2026]This “Contract” applies to the artist further called Seller and person or institution further called Client purchasing from a Seller a work of art further called a Commission. By ordering a Commission from the Seller the Client agrees to the following Terms And Conditions:1. Payment & Process
1. 1. The Client is given a fitted digital sketch and the payment goes through once the received Sketch is accepted by the Client (unless the Seller agrees to a different condition).
1. 2. The Client has the right to ask for unlimited changes during the sketch-phase – which also applies to: asking for new sketches/concepts.
1. 3. The Client has the right to ask for minimal/easy changes after the finished Commission has been sent – though it should be clear that not every change is possible and also not guaranteed.
1. 4. Payment is only accepted through PayPal.
1. 5. The Seller has no responsibility over a lost Commission, if the Commission has already been sent to the Client.
1. 6. The whole communication process will only take place through Discord Direct Messages.2. Refunds
2. 1. The Client has the right to ask for a refund if the Commissions has no further progression after a month, or if the Commission has not been finished after two months.
2. 2. In specific cases where it’s agreed on with both Seller and Client, a different due date will take place.
2. 3. Further requested refunds will not take place – Unless given reason is accepted by the seller.
2. 4. The Seller has the right to cancel a Commission – Issuing a guaranteed refund to the Client.3. Communication
3. 1. Communication between the Seller and the Client should happen in a respectful manner.
3. 2. If the Client’s behavior is disrespectful, the Seller has the right to cancel the Commission WITHOUT issuing a refund.
3. 3. In extreme cases of discriminating behavior, the Seller has the right to never accept any requested Commission from the Client again.4. Commercial Usage
4. 1. An extra 30% of the original commission price is requested/ordered by the seller, if the commission is considered for commercial use (e.g. Merchandise)
4. 2. The Client has the right to discuss the percentual fee with the seller, if the usage of the commission is unclear. The percentage fee might change under consultation between the seller and the client.
4. 3. The Client does not have the right to use a Commission for Commercial usage, without paying the given fee.5. Reselling & AI
5. 1. The Client does not have the right to resell bought Commission (e.g. for more money) without permission from the Seller.
5. 2. Reselling is only accepted with the consent of the Seller and a price reduction of a minimum of 30%.
5. 3. Commissions with bought Commercial Usage fee do not count, if the commercial usage categorizes in selling merchandise.
5. 4. The Client DOES NOT have the right, to use any bought Commission to any form of generative AI!
